General Terms and Conditions (Virtual Escape GmbH in Austria and Virtual Escape Deutschland GmbH in Germany)

1. Scope

​

For all business relationships between Virtual Escape GmbH (short: Virtual Escape),
Linzer Bundesstraße 33, 5023 Salzburg or Virtual Escape Deutschland GmbH (short: Virtual Escape), Sägewerkstraße 3, 83395 Freilassing and the customer are exclusively subject to the following General Terms and Conditions (GTC).

Any other general terms and conditions of the customer will not become part of the contract, even if Virtual Escape also does not expressly object to our performance.

2. Offers, ordering process, conclusion of contract, correction of input errors, storage of contract text

​

2.1 Tickets and vouchers for Virtual Escape can be purchased via our website  www.virtual-escape.games,   or by phone during during our opening times in our business premises (prior registration required). Only persons of legal age are entitled to purchase.

​

2.2 The ticket and voucher offers in our webshop represent a non-binding invitation to order tickets or vouchers for Virtual Escape . By clicking the "Pay now" button when booking the room or "Pay with PayPal" / "Pay now" when purchasing the voucher, the customer makes a legally binding offer to purchase the ticket or the vouchers in the shopping cart. Before sending the order, the customer can view and change the data at any time. Required information is marked with an asterisk (*). The booking number automatically generated by us after the order has been sent documents that we have received your booking, but does not yet represent acceptance of the customer's offer. Mail (booking confirmation including invoice) is sent. With the booking confirmation, the customer receives the ticket code that entitles them to access the booked Virtual Escape mission. In the event that the customer has ordered a voucher, the voucher code will be sent to him in the booking confirmation e-mail, which entitles the customer or the person to whom the customer forwards the voucher to pay the voucher amount when purchasing Virtual Escape - to use tickets as a means of payment.

2.3 The customer must ensure that the e-mail address provided by him for order processing is correct and configured adequately (e.g. with regard to SPAM filters) and has sufficient free storage space.

​

2.4 The customer can correct input errors at any time during the ordering process by clicking on the fields that show the customer which phase of the ordering process he is in and navigating forwards or backwards in this way, or by Browser clicks the "Back" button.

​

2.5 The order text is not saved by us and can no longer be called up after the order process has been completed. The information from the ordering process is sent to the customer again with the e-mail confirmation of the order. The customer can print out the order data immediately after sending the order.

3. Prices, terms of payment

​

3.1 The prices quoted in our web shop include the statutory VAT.

​

3.2 Tickets and vouchers ordered in our online shop can be paid for by credit card (VISA and Mastercard), Sofortüberweisung, PayPal or on site (in cash or with a debit/credit card). We reserve the right to accept other payment methods in individual cases and to reject payment methods in individual cases.

a. payment with credit card

When paying by credit card (Visa and Mastercard), the data is transmitted to stripe using Secure Socket Layer (SSL) encryption technology. The purchase price will be charged to the customer when the order is accepted. The transmission of the data can take a few minutes and must not be interrupted by the customer, for example by refreshing the browser page. Otherwise, the credit card account may be charged twice. We will refund legitimate refund requests within a maximum of 14 days of the customer reporting the double booking. Any costs incurred as a result of any chargebacks initiated by the customer will be passed on to the customer. A processing fee (usually EUR 10) will be charged for unjustified credit card chargebacks. We pass on this fee to the customer accordingly.

Please note that if you choose to pay by credit card, you may have to make a payment without a contract having already been concluded with us, as this only comes into effect once our booking confirmation email has been received (see Section 2.2).

b. Instant bank transfer

SOFORT transfer is a direct transfer procedure from SOFORT AG based on the high security standards of online banking with PIN/TAN entry for secure and fast processing of online purchases. Using the secure SOFORT AG payment form, which is not accessible to retailers, SOFORT transfer automatically and in real time places a transfer in the customer's online bank account. The purchase amount is transferred immediately and directly to the retailer's bank account. The only requirement for using SOFORT transfer is access to an online bank account. Please note that even with the SOFORT transfer payment method, you may have to make a payment without a purchase contract having already been concluded with us, as this only comes into effect once our booking confirmation email has been received (cf. Section 2.2). After completing the order, you will be automatically redirected to the Sofortüberweisung.de website to make the payment. Your bank account will be debited upon completion of the payment at Sofortüberweisung.at.

c. Payment via Paypal

PayPal is an online payment service provided by PayPal (Europe) S.à rl & Cie, SCA The use of PayPal requires that you have a PayPal customer account in which your bank or credit card details are stored. If you have selected the "PayPal" payment method, you will be forwarded to PayPal after completing the order. There you log into your PayPal account with your e-mail address and the password you provided and confirm the payment. You will receive a payment confirmation from PayPal via email. PayPal charges your customer account with the corresponding purchase price and transfers this to our seller account. For more information, see   www.paypal.at .

Please note that with the PayPal payment method, you may make a payment without a contract having already been concluded with us, as this only comes into effect when our booking confirmation email is received (see Section 2.2).

4. Right of Withdrawal

​

4.1 There is no right of withdrawal for contracts for the provision of services in connection with leisure activities, if the contract has a specific date or period of performance provides. The purchase of tickets for Virtual Escape missions can therefore not be revoked by the customer.

​

4.2 The following also applies:

If the customer is a natural person who concludes a legal transaction for a purpose that is predominantly neither commercial nor self-employed (consumer), the customer has a right of withdrawal . With regard to the requirements and legal consequences of the right of cancellation, reference is made to the cancellation policy in the appendix.

5. Booking Conditions

​

5.1 Virtual Escape is a team game for people from 10 to 99 years old. Children and young people who are not accompanied by a legal guardian or an adult supervisor must submit a declaration of consent signed by a legal guardian to participate in Virtual Escape missions without being asked. From the age of 10, children count as full-paying adults.

​

5.2 Virtual Escape GmbH is entitled to refuse visitors access to Virtual Escape if there is a fear that the person or persons concerned would disrupt general business operations or harass other visitors due to alcohol or drug consumption or for other reasons. In these cases, the ticket price or voucher value will not be refunded.

​

5.3 Please note that Virtual Escape is a live event. Since the Virtual Escape rooms are specially prepared for each booking and blocked for the booked period, it is your responsibility to show up on time for the booked period. In case of delays, Virtual Escape GmbH reserves the right to refuse entry to the relevant Virtual Escape mission. The ticket expires and there is no right to a refund.

5.4 It is not permitted to take food and drinks that you have brought with you.

​

5.5 It is not permitted to bring bulky or dangerous objects, fireworks or other pyrotechnic objects, weapons and dangerous tools, aerosol cans, noise instruments, laser pens, bottles, cans, intoxicants and animals - with the exception of those used for Support for physical or mental disabilities are required – take them with you.

​

5.6 With the exception of mobile phones, it is not permitted to take picture, film and sound recording devices with you.

​

5.7 It is not permitted to make audio, visual or film recordings during the performance of the Virtual Escape missions or from the Virtual Escape premises or to make such recordings in whole or in part via the Internet or others transmit or distribute any media (including cellular).

​

5.8 Significant or repeated violations of laws or these terms and conditions may be punished with eviction from the Virtual Escape premises without refund of the ticket price or voucher value and with house ban.

6. Cancellations

​

6.1 You have the option of canceling or rebooking the appointment free of charge up to 72 hours before the start of the game. A simple email to  office@virtual-escape.at in Austria or deutschland@virtual-escape.games in Germany is sufficient. Cancellation by telephone is NOT possible.

​

6.2 If the cancellation period of 72 hours is not observed, the customer is not entitled to a refund of the amount already paid.

​

​

7. Changes in Services

​

Deviations in content and changes to the Virtual Escape missions after booking are only made if necessary, provided they are not significant and do not significantly affect the overall content or the effect of the booked mission.

​

​

8. Sound, image and film recordings

​

8.1 Virtual Escape is entitled to create sound, image and film recordings of the customer and his teammates during the Virtual Escape missions, which are necessary for the execution of the game.

​

8.2 The customer agrees that specially created team photos can be published and distributed online via the Virtual Escape social media channels (Facebook, Twitter, Youtube, Google+). The consent is expressly given with the waiver of a claim for remuneration. The customer can revoke this consent at any time - at the latest when the team photo is taken.

​

9. Liability

​

In the case of impossibility and delay as well as the breach of essential contractual obligations, we are also liable for slight negligence, but then limited to the typically foreseeable damage. Essential contractual obligations (cardinal obligations) are those contractual obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may also rely. Typical, foreseeable damages are those that fall under the protective purpose of the breached contractual standard. Otherwise we are not liable for slight negligence. The above limitations of liability also apply to our organs and vicarious agents.

10. Set-Off, Contract Language, Applicable Law and Jurisdiction

​

10.1 The customer is only entitled to offset if his claim is undisputed or has been legally established, unless it is a claim from the same contractual relationship. The customer is only entitled to a right of retention if his counterclaim is based on the same contractual relationship.

​

10.2 The contract is concluded in German. All disputes arising from the legal relationship between the customer and us are subject to Austrian law. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence. The validity of UN purchasing law is excluded.

​

10.3 Place of jurisdiction is the place of business of Virtual Escape GmbH, if the customer is a merchant, a legal entity under public law or a special fund under public law.

​

Right of withdrawal

​

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day the contract was concluded. In order to exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

​

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract.

For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

If you have requested that the services should begin during the cancellation period, you must pay us a reasonable amount that corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.
